Key Summary
We are Untamed and Unchained Limited trading as Constellation AI. We are providers of a technical platform and application experience that helps you design and build the life you want.

We process your data in order to register your details and so you can use our mobile application ("App") under a contract with us ("Terms of Use"). The Terms of Use can be found at https://constellation.ai/terms

We use artificial intelligence technology to make suggestions designed to help you achieve the goals, ambitions or wishes that you record in the App. The artificial intelligence technology uses the data that you enter into the App and creates a profile of you.

When you download the App you will be asked if you want to use location tracking features when you use our App. We use location tracking technology to determine where you are because some of the services in the App require location data for the feature to work. If you decide to use location tracking features with the App you can elect to disable the location tracking technology at any time by entering the phone settings menu and selecting location services

We only use the profile data, the location tracking data and other information you record in the App so that you can make use of the functionality in the App and the App can make automated suggestions to you that help you take steps towards your goals, ambitions and wishes. We do use an anonymised version of some of your personal data in order to train our artificial intelligence systems so that they can deliver improved functionality in the App .

If you do not want us to create a profile of you then you should not use the App because the App will not function properly if we cannot create a profile offor you.

You can delete the App and the data you store in the App at any time by uninstalling the application or by sending an email request to privacy@constellation.ai or by using the contact details set out in this Privacy Notice.

If you choose to store sensitive data about yourself in the App for example, information about your health, sexual orientation, religious or political beliefs (known as "special categories of data") then we can only store and process that data lawfully if we have your explicit consent. You will have been asked to tick athe box giving us explicit consent to process special categories of data when you signed up to download the App. There is no obligation on you to give us explicit consent to process any special categories of data but if you chose not to tick the box then you must not record such data in the App.

This Privacy Notice explains more about the data we process, why, how it is legal and your rights.


About us and this notice
Untamed & Unchained Ltd trading as Constellation AI ('we' or 'us') are a 'data controller' for the purposes of the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018 ("Data Protection Laws"), and we are responsible for, and control the processing of, your personal information.

This Privacy Notice (the "Privacy Notice") relates to Untamed & Unchained Ltd and is located on/can be found at the website www.constellation.ai.  If you would like this notice in another format (for example: audio, large print or braille) then please contact us at the address below.

We take your privacy very seriously and we ask that you read this Privacy Notice carefully as it contains important information about our processing and your rights.

We may change this Privacy Notice from time to time. We will email you when changes are made.


Useful words and phrases
Please familiarise yourself with the following words and phrases (used in bold) as they have particular meanings in the Data Protection Laws and are used throughout this Privacy Notice:

Personal data
This means any information from which a living individual can be identified. 

This will include information such as telephone numbers, names, addresses, e-mail addresses, photographs, voice recordings.  It will also include expressions of opinion and indications of intentions about you (and your own expressions of opinion/intentions).

It will also cover information which on its own does not identify someone but which would identify them if put together with other information which we have or are likely to have in the future.

Special categories of data
This means any information relating to:

  • racial or ethnic origin;
  • political opinions;
  • religious beliefs or beliefs of a similar nature;
  • trade union membership;
  • physical or mental health or condition;
  • sexual life; or genetic data or biometric data for the purpose of uniquely identifying you

Processing
This covers virtually anything anyone can do with personal data, including:

  • obtaining, recording, retrieving, consulting or holding it;
  • organising, adapting or altering it;
  • disclosing, disseminating or otherwise making it available; and
  • aligning, blocking, erasing or destroying it.


Data subject   
The person to whom the personal data relates.

ICO
This means the UK Information Commissioner's Office which is responsible for implementing, overseeing and enforcing the Data Protection Laws.

Data controller
This means any person who determines the purposes for which, and the manner in which, any personal data are processed.

Data processor
This means any person who processes the personal data on behalf of the data controller.

Data Protection Laws
This means the laws which govern the handling of data. This includes the General Data Protection Regulation (EU) 2016/679 and the Data Protection Act 2018
  
What information do we collect and hold?
We collect the following personal data about you when you register to use and download the App.

  • Name
  • Address
  • Phone number
  • Email address
  • Date of birth
  • None

We hold the following personal data about you as a result of you using the App.

  • The ID of your mobile phone
  • Your location  (unless you have disabled the feature)
  • Your profile
  • Any personal information you choose to record in the App
  • Any special categories of data that you choose to record in the App
     

Personal information about other individuals

If you provide us with information about other individuals you confirm that you have informed the relevant individuals accordingly.


Why do we process your personal data?
We use your personal data for the following purposes listed in this section. We are allowed to do so on certain legal bases (please see section 'How is processing your data lawful' for further detail).

Register you to use the App
We need to know who you are so we can register you to use the App and ensure that you have agreed to the Terms of Use

Provide the App and the functionality enabled by the App
The App stores personal information about you and uses that information to make automated suggestions relating to the goals, ambitions or wishes that you record in the App

Track your location
If you have consented to the use of location tracking on your device then we use location tracking technology to determine where you are because some of the functions in the App require your location data. You can elect to disable the location tracking technology at any time by entering the phone settings menu and selecting location services

Create a profile of you from the information about you stored in the App
The App uses artificial intelligence technology to create a profile of you to make automated suggestions relating to the goals, ambitions or wishes that you record in the App

Ask you to feedback on the App and our services
We do this so we can improve our services to you.

Monitor the usage of the App
We do this so we can improve our services to you

Improve the performance of the artificial intelligence systems in our App
We use an anonymised version of some of your personal data in order to train our artificial intelligence systems so that they can deliver improved functionality in the App .


 
How is processing your personal data lawful?

Personal Data
We are allowed to process your personal data for the following reasons and on the following legal basis:

Contract
It is necessary to process your personal data so you can use the App and so we can perform the contract you have with us. If we do not process your personal data, we will not be able to provide the App or provide you with the functionality in the App. The App relies on artificial intelligence technology to create a profile of you. If we cannot create a profile then we cannot make automated suggestions that may help you achieve the goals, ambitions or wishes that you record in the App.

Legitimate interests
We use an anonymised version of some of your personal data in order to train our artificial intelligence systems so that they can deliver improved functionality in the App. It is in our legitimate interests to do this in order that our artificial intelligences systems can model users and we can improve their ability to make suggestions that help achieve individual's goals, ambitions and wishes. To safeguard the data we anonymise it so that you cannot be identified from that data.

Consent
If you have consented to the use of your location data by us then we will use that to make automated suggestions to you that may help you achieve the goals, ambitions or wishes that you record in the App. You can elect to disable the location tracking technology at any time (and withdraw your consent to us using your location data) by entering the phone settings menu and selecting location services.



Special Categories of Data
We are allowed to process your special categories of personal data for the following reasons and on the following legal basis:

 Consent
You have given your explicit consent for us to process any special categories of personal data that you choose to record in the App. You can withdraw consent to the processing of special categories of data at any time by sending an email request to privacy@constellation.ai or contacting us- see "How to contact us" section.

 
 

Who will have access to your personal data and how we keep it secure?

Below lists one some of our key service providers that act acts as our processors and with whom we share your personal data.

 How we keep your data secure

We use technical and organisational measures to safeguard your personal data.  If you want to know how we are keeping your data secure, email privacy@constellation.ai.

Whilst we will use all reasonable efforts to safeguard your personal data, you acknowledge that the use of the internet is not entirely secure and for this reason we cannot guarantee the security or integrity of any personal data that are transferred from you or to you via the internet.

If you have any particular concerns about your information, please contact us (see ‘How to contact us?’ above).


When will we delete your data?

We will generally retain your personal data and special categories of data whilst you are using the App. We will delete all the personal data stored in the App within 24 hours of the contract between us for the use of the App ending. We will keep a record of your name and address and the period during which you used the App for 5years after the contract between us has ended.

 
Your rights

As a data subject, you have the following rights under the Data Protection Laws:

  •  the right to object to processing of your personal data
  • the right of access to personal data relating to you;
  • the right to correct any mistakes in your information;
  • rights in relation to automated decision making (not relevant for you under this Privacy Notice); 
  • the right to restrict or prevent the processing of your personal data;
  • the right to have your personal data ported to another controller (e.g. if you decided you wanted to give your information to another service provider or you just wanted a copy);
  • the right to erasure; and the right to withdraw consent to your personal data being processed.

These rights are explained in more detail below, but if you have any comments, concerns or complaints about the use of your Personal Data by us, please contact us at privacy@constellation.ai (or please refer to section "How to contact us").

We will respond to any rights that you exercise within a month of receiving your request, unless the request is particularly complex, in which case we will respond within three months.

Please be aware that there are exceptions that apply to some of the rights so not all of them apply to the processing we do under this Privacy Notice.


Right to object to processing of your Personal Data
You may object to us processing your personal data where we rely on a legitimate interest as our legal grounds for processing.

This is not relevant to you because we do not rely on legitimate interests as a ground for processing your personal data. 

The section headed "How is processing your personal data lawful" explains where this is the case.

If you object to us processing your personal data we will no longer be able to process your personal data unless we can demonstrate compelling grounds for continuing to do so. We believe we have demonstrated compelling grounds in the section headed " How is processing your personal data lawful".  process

 
Right to access Personal Data relating to you
You may ask to see what personal data we hold about you and be provided with:

  • a copy;
  • details of the purpose for which it is being or is to be processed;
  • details of the recipients or classes of recipients to whom it is or may be disclosed, including if they are overseas and what protections are used for those oversea transfers;
  • the period for which it is held (or the criteria we use to determine how long it is held);
  • any information available about the source of that data; and
  • whether we carry out any automated decision-making, including profiling, and where we do information about the logic involved and the envisaged outcome or consequences of that decision or profiling.

To help us find the information easily, please provide us as much information as possible about the type of information you would like to see.

 
Right to correct any mistakes in your information
You can free of charge require us to correct any mistakes in your information. If you would like to do this, please:

  • please contact us at privacy@constellation.ai (or please refer to section "How to contact us");
  • let us know the information that is incorrect and how it needs to be corrected; and let us have enough information to identify you

 
Rights in relation to automated decision making
We profile you in order to make automated suggestions to you that may help you achieve the goals, ambitions or wishes that you record in the App. We do not make any automated decisions about you that have a legal or similarly significant effect on you and therefore the rights under Data Protection Laws in relation to automated decision making do not apply to you.

 
Right to restrict processing of Personal Data
You may request that we stop processing your personal data temporarily if:

  • you do not think that your data is accurate. We will start processing again once we have checked whether or not it is accurate;
  • the processing is unlawful but you do not want us to erase your data;
  • we no longer need the personal data for our processing, but you need the data to establish, exercise or defend legal claims; or
  • you have objected to processing because you believe that your interests should override our legitimate interests.

 
Copies of your Personal Data (data portability)
You may ask for an electronic copy of your personal data which you have provided to us as part of your use of the App and which we hold electronically. You can also ask us to provide this directly to another party.

 
Right to erasure
You can ask us to erase your personal data where:

  • you do not believe that we need your data in order to process it for the purposes set out in this Privacy Notice;
  • if you had given us consent to process your data, you withdraw that consent and we cannot otherwise legally process your data;
  • you object to our processing and we do not have any legitimate interests that mean we can continue to process your data; or
  • your data has been processed unlawfully or have not been erased when it should have been.

Right to withdraw consent

What will happen if your rights are breached?
You may be entitled to compensation for damage caused by contravention of the Data Protection Laws.


Complaints to the regulator
It is important that you ensure you have read this Privacy Notice - and if you do not think that we have processed your data in accordance with this notice - you should let us know as soon as possible. Similarly, you may complain to the ICO. Information about how to do this is available on the ICO's website at www.ico.org.uk.
